By applying for membership and participating in activities at or hosted by Pendulum Society, you acknowledge that you have read, understood and agree to adhere to our Code of Conduct, Privacy Policy and Liability Agreement. Membership is contingent upon your acceptance of these requirements and is non-negotiable.
We strive to maintain a respectful and safe environment for all members, and your cooperation is essential in upholding the values of Pendulum Society and the community. If you do not agree to these terms, we respectfully ask that you refrain from joining.
Member code of Conduct
At Pendulum Society, we prioritize the well-being and comfort of our community members. Our Code of Conduct establishes the values and guidelines that ensure a safe, respectful and enjoyable environment for everyone involved in the lifestyle. We believe that open communication, consent and mutual respect are vital to fostering positive interactions.
Rules, Conduct, and Consent
- I confirm that I am at least 21 years old and that the information provided is accurate.
- I agree to respect the privacy, boundaries, and preferences of all members.
- I consent to adhere to the club’s rules, policies, and event guidelines.
- I understand that all participation in club activities is voluntary and based on informed
consent.
- I agree that sharing club details, member identities, or event content with non-members is
strictly prohibited.
Privacy Policy
Equally important is our commitment to maintaining the privacy of our members while attending a Pendulum Society event. We adhere to stringent measures to safeguard your privacy, with a clear understanding that sharing club details, member identities, or event content with non-members is
strictly prohibited. Anyone caught violating.
Non-Disclosure Agreement (NDA)
This agreement is entered into by the undersigned (“Member”) and Pendulum Society. By
agreeing to this NDA, you agree to the following terms:
- Confidentiality Obligations:
o All information shared within the club, including but not limited to member
identities, discussions, events, and activities, is strictly confidential.
o You agree not to disclose, share, or reproduce any confidential information with
any third party without express written permission from The Club.
- No Recording or Documentation:
o The use of cameras, recording devices, or note-taking to capture any club-related
activities is prohibited unless expressly authorized.
- Breach of NDA:
o Any violation of this agreement may result in immediate termination of
membership and potential legal action to address damages caused.
- Term of Agreement:
o This NDA remains binding for the duration of your membership and for five (5)
years after termination of your membership.
Pendulum Society Liability Waiver
As a member, you hereby acknowledge that you are voluntarily participating in activities and using the facilities and equipment provided by the Pendulum Society and understand and acknowledge the potential risks and hazards associated with any physical activity, including but not limited to injury, illness, or death. I voluntarily assume full responsibility for any risks, injuries, or damages that may occur as a result of my participation.
By agreeing to these terms you hereby release, discharge, and hold harmless the Pendulum Society, its owners, employees, agents, and representatives from any and all claims, liabilities, demands, actions, or causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while using the facilities or participating in activities at the Pendulum Society.
You also agree to comply with all society rules, regulations, and instructions provided by the staff for your safety.
I understand that this waiver includes any claims based on the negligence, action, or inaction of The
Pendulum Society, its owners, employees, agents, and representatives, whether a COVID-19-related
claim or otherwise.
“BY AGREEING TO THESE TERMS YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS,
INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF
THE OCCUPIERS LIABILITY ACT OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT”
