1. Purpose and Commitment

Pendulum Society (“Pendulum”, “we”, “our”, “us”) is a private, adult-only membership social club serving individuals in British Columbia and Alberta.

Due to the highly personal and sensitive nature of our community, we apply enhanced confidentiality and security standards to all personal information entrusted to us.

This Policy explains how we collect, use, disclose, retain, and safeguard personal information in accordance with applicable Canadian privacy legislation.


2. Eligibility

Membership and website access are strictly limited to individuals:

  • 19 years of age or older (British Columbia)
  • 18 years of age or older (Alberta)

We do not knowingly collect or retain information from minors.


3. Categories of Personal Information Collected

We collect only information reasonably necessary to operate a secure and vetted private club.

A. Registration & Account Information

  • Legal name and/or chosen display name
  • Email address
  • Telephone number
  • City or region of residence
  • Date of birth
  • Username and encrypted password

B. Identity Verification (In-Person)

  • Government-issued photo identification is reviewed in person.
  • Identification documents are not scanned, copied, or stored electronically unless explicitly stated otherwise.

C. Photographs & Verification Media (Electronically)

  • Profile photographs
  • Verification photographs for authenticity screening
  • Photos voluntarily uploaded by members

These materials are considered highly sensitive and are subject to restricted administrative access.

D. Technical Data

  • IP address
  • Login timestamps
  • Device/browser metadata

We do not use Google Analytics at this time.


4. Purpose of Collection

Personal information is collected solely for the following purposes:

  • Age and identity verification
  • Member vetting and safety screening
  • Account administration
  • Event management
  • Internal record keeping
  • Enforcement of club rules
  • Communication regarding membership matters
  • Compliance with legal obligations

We do not collect information for unrelated commercial profiling or resale.


5. Consent

By creating an account, submitting photographs, or participating in membership activities, individuals consent to the collection, use, and retention of their personal information as described in this Policy.

Members may withdraw consent by requesting account deletion. Withdrawal may result in termination of membership where retention of certain data is operationally required.


6. Disclosure of Personal Information

Pendulum Society does not sell, rent, trade, or commercially distribute personal information.

Information may be disclosed only:

  • To contracted service providers for secure hosting or IT maintenance
  • Where required by court order or law enforcement request
  • To comply with applicable laws
  • To protect the safety or legal rights of the club or its members

All third-party service providers are contractually required to maintain confidentiality and implement appropriate safeguards.


7. Storage & Safeguards

We implement reasonable physical, organizational, and technical safeguards, including:

  • SSL/TLS encryption
  • Secure server hosting
  • Password hashing and encryption
  • Role-based administrative access controls
  • Two-factor authentication for administrative access (where implemented)
  • Confidentiality obligations for administrators

Access to verification photographs is strictly limited to authorized personnel involved in screening and safety oversight.

No internet transmission or electronic storage system can be guaranteed 100% secure. Members acknowledge this inherent risk.


8. Photo Confidentiality & Restrictions

Member photographs are:

  • Not publicly searchable
  • Not shared outside the membership platform without consent
  • Restricted from administrative download except where necessary for investigation or safety

Membership photo and personal information is not shared or accessible publicly on www.thependulumsociety.com website. As such members are strictly prohibited from copying, screenshotting, redistributing, or sharing any other member’s content.

Violation may result in immediate termination of membership and potential legal action.


9. Data Retention

We retain personal information only as long as reasonably necessary for operational and legal purposes.

  • Active member data is retained during membership.
  • Inactive accounts may be deleted after 24 months of inactivity.
  • Upon account termination, profile data and photos are deleted within 30 days unless required for dispute resolution, rule enforcement, or legal compliance.

Administrative logs may be retained longer for security auditing purposes.


10. Cross-Province & Hosting

While serving British Columbia and Alberta, data may be stored on secure servers located within Canada.

We take reasonable steps to ensure comparable privacy safeguards are applied regardless of server location.


11. Access & Correction Rights

Members may submit written requests to:

  • Access their stored personal information
  • Correct inaccuracies
  • Request deletion of their account

Identity verification may be required before fulfilling requests.


12. Breach Response

In the event of a security breach posing a real risk of significant harm, we will:

  • Assess the scope and impact immediately
  • Notify affected individuals as required by law
  • Notify the appropriate privacy regulator where legally required
  • Take corrective measures to mitigate risk
